| 摘 要： | 婚内强迫性行为是一个非常敏感的话题,对其性质的认定众说纷纭。从现行法律和法学理论两个角度探讨婚内强迫性行为的性质问题,在不同的情况下婚内强迫性行为可以构成侵权,亦可构成犯罪,关键是把握好一定的原则。
