The origin of the Normative Validity of the Law——Unscrambling the Extension of Rawls's and Habermas's Moral Philosophy to Legal Philosophy

Based on the theory of justice,Rawls abides by the contractual model and maintains that the normative validity of the law lies in the principles of justice. Obeying the discourse model,Habermas proposes that the normative validity of the law originates from the democratic legislative procedure.Meanwhile,he advocates that the law validity is the inherent integration of the facticity and normative validity.On the normative validity of the law,this study mainly expounds the explanatory their paradigms.Moreover,the paper makes a brief evaluation of their contribution and limitations.
