尼莫形象权法律思想评析

摘    要:形象权是指自然人控制其形象进行商业利用的专有性权利。美国学者尼莫通过对现实经济发展需求和隐私权制度失衡的分析,阐述了构建形象权产生的必然性。同时,其对形象权客体范围和限制理论的阐释,也为以后的研究活动构建了理论框架。

Abstract:The right of publicity is the right of every human being to control the commercial use of his or her identity. Through analysis on economic needs and the shortage of the right of privacy, Nimmer expounds and proves the inevitability of creating the new right. At same time, Nimmer's researching on object and the theory of limitation of the right of publicity has structure the Theoretical Framework of the right of publicity. So, researching on his the theory of the right of publicity can clearly comprehend the historical development of the right of publicity.
