论旅行社行业不正当竞争

《中华人民共和国反不正当竞争法》对各行各业的不正当竞争行为作了概括性的规定,但在旅游实践中涉及旅行社之间不正当竞争的问题还存在许多不足和欠缺。国内很多专家学者对此也发表了不同的意见和建议。本文通过分析旅行社间的不正当竞争出现的原因,提出解决问题的对策,旨在强化政府对旅行社业的引导,规范旅游竞争市场,杜绝旅行社之间的不正当竞争,使旅行社之间开展有序的良性竞争,创造更好的旅游法制环境,从而保证我国旅游业朝着健康的方向发展。

Unfair Competition in Travel Service Industry

The Anti-Unfair Competition Law of People＇s Republic of China makes a general provision on the unfair competition in all walks of life.However,there still exist problems of deficiencies and gaps among the travel agents in their competitive practice.Many domestic experts and scholars have expressed different views and suggestions on such problems.By analyzing the reasons which have caused the unfair competition among the travel agents,the author puts forward solutions to the problems so as to strengthen the government guidance to travel service industry,standardize the competition and prevent unfair competition in tourism market.On the other hand,the author proposes suggestions on how to conduct orderly and healthy competition and how to create better travelling environment in order to ensure a kind of healthy development of our travel industry.
