大学生保险本体问题研究

大学生保险实践开展有较长一段时间了,但关于大学生保险理论研究却很少,以致大学生保险的概念、特征、性质、种类等本体问题至今未有定论。对上述问题进行系统研究,认为大学生保险是商业保险和社会保险的综合,具有商业保险和社会保险的共性,是经济补偿和社会保障的综合,而社会保险更显重要;它具有自愿与强制相结合、被保险人主体特殊等基本特征;其险种包括社会医疗保险、商业医疗保险、平安保险等多种类型。这些问题的解决对大学生保险法律制度体系建立具有重要意义。

Studies on Noumenal Issues of Insurance for College Students

College students’ insurance has been put into practice for some time,but there is little research on college students’ insurance theory,which leaves such noumenal issues as its concept,characteristics,properties,types and so forth unsettled.This paper addresses these issues systematically,believing that college students’ insurance is a combination of the commercial insurance and social insurance with their common features,and a mixture of the economic compensation and social security with more stress put on the latter;it has some basic characteristics,for example,it’s on both a voluntary and a mandatory basis,and the insured subject is special;its coverage includes social medical insurance,commercial medical insurance,safe insurance,etc.The solution to these problems is of great significance for establishing a legal system for college students’ insurance.
