论利益衡量原则的实践进路

虽然不少法官对利益衡量概念和运用没有完整的和系统的认识，但利益衡量方法在司法审判实践中的运用却十分普遍。利益衡量的本质是一种主观作为，该方法在实践中的操作和规范并未引起理论界和实务界的足够关注。为此，本文利益衡量的构成要件以及实践进路进行分析，以期对开拓利益衡量思路、规范利益衡量程序有所裨益。

On the Practice of Interest Measurements

Although many judges aren＇ t familiar well with the concept and the use of interest measurements, the method of interest measurements is widespread in judicial trial practice. The essence of interest measurements is a subjective behaviors ; furthermore, there is not enough concern on its operation and norms in theory and practice. So this paper analyses the composing elements and the practice of interest measurements for the sake of widening thinking and regulating procedures.
