| 摘 要： | 中国传统法律最主要的特征，就是以“礼”为其本土资源。在进行当代中国法治建设时，仍然不能忽视“礼”的传统。在新的法制背景下，传统礼法关系对当代法治的借鉴意义主要表现在划分道德与法律的边界、推进道德的不断法律化、引导法律的不断道德化和建构德法同治模式四个方面。

| Abstract: | The traditional Chinese law was based on rites. In building the rule of law in contemporary China, the traditions of ＂rites＂ cannot be neglected. In the new legal context, the main referential significance of the traditional rites for the rule of law lies in demarcating the division between morality and law, promoting the legalization of morality, guiding the moralization of law, and constructing a governance model of the rule of both morality and law. |
