| 摘 要： | 春秋期间郑国“铸刑书”和晋国“铸刑鼎”的重要意义．并不在于“是中国历史上第一、二次公布成文法”，而是在周天子势衰，周朝法律制度失去作用后．各强国在政治上争霸的同时，也在制订和公布自己的法律制度方面争霸的反映，而其中尤其以郑国“铸刑书”和晋国“铸刑鼎”为典型。叔向和孔子对此提出的批评意见，并不是反对公布成文法，而是反对这些国家抛弃周朝的法律制度而代之以自己国家的法律制度。
