在中日甲午丰岛海战中,清政府雇用的英国运输轮"高升"号在向朝鲜运送清军途中,被日舰"浪速"号蓄意击沉,大英帝国震怒.然而经过外交斡旋,日本反使英国认定清政府对此事负有全责并向其提出索赔要求.以往论者多以英国法学界专家撰文支持日本或英国在远东执行"联日防俄"的政策为理由解释英国政府态度转变的原因,本文认为,英国维护自己在华利益、事件调查中新证据的发现以及普通法法系(英美法系)价值准则的应用同英国维护英日友好关系的政策一起,成为英国政府态度转变的原因.

Analysis of the attitudinal change of Chinese and British governments upon the Gaosheng incident

During the Sino-Japanese war of 1894-1895,the Qing-hired Britain-made Gaosheng vessel is destroyed by Japanese warship on the way to Korea.Britain is shocked,yet,Japan succeeds in asking the Qing to pay for the loss.Previous studies conclude that Britain performs the policy of uniting Japan against Russia in the far east.However,the writer argues that Britain intends to maintain interest in China and friendship with Japan and applies their common law.
