| 摘 要： | 随着耕地保护的加强和城市可供土地的日渐减少,商业拆迁将会替代土地征收成为不动产权利冲突的热点。分析现行拆迁模式下权利规则的弊病,借鉴法经济学者倡导的财产规则和责任规则,构建新的商业拆迁权利规则。该规则应兼顾公平和效率,能够有效平衡商业拆迁过程中各方的利益,构筑新的拆迁模式。

| Abstract: | Due to the protection of farmland and the reduction of urban land supply,the right conflict in commercial demolition and removal of urban house will be the central issue,instead of the conflict in the rural land levy.Through analyzing the malady of current rules,this article,referring to the property rule and liability rule advocated by economic scholars,develops a new property right rule of the commercial demolition and removal.The new rule,taking into account both fairness and efficiency,can balance all parties＇ benefits to build a new demolition and removal model. |
