| 摘 要： | 合同相对性原则作为合同领域的一项重要原则自罗马法以来,一直为两大法系所确认,但随着现代商业交易的复杂化,合同相对性原则已在许多交易领域变得力不从心,严重影响了社会交易的效率和安全。本文主要立足于中国合同法立法现状,论述了合同相对性原则及其例外历史渊源和发展演变,在分析借鉴两大法系其他国家合同立法先进成果的同时,为完善我国合同立法提出了几点建议。

| Abstract: | Due to the increasing complexity of the modern transactions,the relativity principle of the contract,an important principle in the law of contract,is getting beyond its capacities in the world of business.As a result,the transaction efficiency and security is affected.The thesis initially studies the origin and historic development of the principle plus its exceptions.Then suggestions,based on lessons learnt from the contract law of other countries,are raised in an effort to perfect the legislation of the contract law of our country. |
