基于大陆法系与英美法系因其在文化传统、法律渊源、思维方式的不同考量，两大法系在因果关系理论方面呈现出不同方式。我国构建侵权因果关系时，结构上采用英羡法系的两分法，即区分事实因果关系与法律因果关系.

On the Judgement of Tort Liability Causation in China

Based on differences between the continental law and the western law in the cultural tradition, the sources of law and the way of thinking, the two laws present different ways in the causation theory. Before forming the tort causation, two factors, the theory and the structure, need considering, the essence of the causation theroy in two laws should be adopted, and two distributions in the western law, distinguishing the factual causation and the law causa- tion should be accepted structurally.
