| 摘 要： | 中德两国的林地物权变动制度设计相同之处在于公法色彩较为浓厚。其区别在于:在登记制度上,德国实行法院下属登记所负责不动产登记,但部分州单设森林登记,而中国森林登记机关为林业主管机关;在变动模式上,德国采耿‘实质审查+登记要件主义+无因”,而中国采用“实质审查+对抗主义”模式。变动制度的不同,是由两国国情决定的。

| Abstract: | The similarity of the design of forest land real right alteration between China and Germany is that both of them are of public laws. As for registration system, Bureau of Judicatory registers the real estate in Germany (but in some states forests are registered independently), while forestry departments at county level and above are responsible for registering forests in China. As for the alteration mode, Germany adopts the mode of "true checking + register as a must + no reason" , but China adopts "real checking + resist" mode. The difference is caused by the different situations in the two countries. |
