《校园安全法》立法原则性问题研究

近几年来,校园持续不断地发生学生意外伤亡事故,由于没有直接的法律依据,使得伤害事故难以得到完满的解决,学生的人身权、财产权等基本权利也因为情况特殊而得不到相应的保障。为了保障学生的合法权益,《校园安全法》有其立法的必要性,其立法应遵循安全第一、结合实际、科学性、可操作性、综合治理等原则。

On the Legislative Principles of Campus Security Law

In recent years students are often injured or killed on campu s and these accidents can't be tackled justly due to the lack of direct legal basi s.Students' basic rights such as personal right and property right can't be gua ranteed because of the special circumstances.To guarantee students' legitimate rights and interests,there is the necessity of having Campus Security Law which should abide by the principles of security being the first,being in light of t he actual conditions,science,operativity and comprehensive administration.
