| 摘 要： | 韩非子是战国时期法家的集大成者,他从人性恶出发,否定以"礼"节制人性,主张用"法"取代"礼","治民无常,唯法为治",主张严刑峻法,"杀戮禁诛谓之法".他强调在法律面前,除君主以外,一律平等."法不阿贵……刑过不避大臣"(<有度>).本文主要论述了韩非子的法和法治思想.
