论农民专业合作社的成员权利

农民专业合作社成员权利既是合作社一切权利的基础，也是合作社一切权利的来源。农民是最主要的权利主体。成员权是一种综合权利，包括非经济性共益权与经济性自益权。农民专业合作社法依据合作社基本原则，明确赋予成员民主管理、资产所有、资产收益和接受合作社服务的基本权利，以区别合作社法人财产权。为保护成员合法权益，农民专业合作社法应当建立成诡权利救济制度．成为一部护权型、可诉型的法律。

On Member Right of the Farmer Cooperative

Member right is not only the foundation but also the source of all rights in farmer cooperative.The farmers are the main subjects of rights.Member right is a kind of comprehensive right,including the non-economic benefit right and economic individual benefit right.According to the basic principles of farmer cooperative,it definitely gives member basic rights such as the democratic management,the property ownership,the property income and the basic right to receive cooperative service,which is different from the property right of cooperative legal person.In order to protect members' legal rights,the farmer cooperative should set up the member right relief system which is protecting and helpful.
