最新贪污贿赂司法解释对罪刑法定原则的重申与背离

司法解释如何在罪刑法定原则的指导下对立法者原意进行解读，一直以来就存在很大争议，新出台的贪污贿赂司法解释也不例外。《解释》对于贪腐类犯罪情节加数额的规定体现了罪刑法定原则对于合理性和合法性的要求，明确了刑法修改之后的一些争议问题。但从体系解释的角度上来说，贪污贿赂一章的犯罪内部以及贪污贿赂与其他财产犯罪之间都存在对接上的障碍。另外，模糊性用语的出现，也给司法解释的适用带来了很大的难题。

The Reiterate and Departure Between the Latest Judicial Explanation and the Principle of Legally Prescribed Punishment

It has always been a controversy of reading judicial interpretation under the guidance of the principle of a legally prescribed punishment and the interpretation of legislators ’ intent ,and the new corrup‐tion of judicial interpretation was no exception .“Explanation” was more legal and reasonable ,especially in the regulation of plot and amount ,making it clear of some controversy .But ,from the angle of system ex‐plaining ,the chapter crime of corruption reveals the obstacles within and between corruption and other property crimes .In addition ,the emergence of vague words makes it more difficult to apply to the judicial in‐terpretation .
