普法与乡村社会中的法律控制

法律控制的关键是法律能对人们的行为产生影响,就乡村社会来说,人们能否接受法律控制的关键在于两个方面:一是能否接受法律所提供的权利观念,二是法律能否为其权利提供保障,法律是否具有解决问题的能力。对于普法来说,第一个方面相对来说容易实现,而对第二个方面,则不仅要求基层政府依法行政,而且也要求乡村自治组织真正发挥自治职能,能够为个人权利和政府权力之间提供一个缓冲地带,从而真正实现法律对乡村社会的有效控制。

The Promulgation of Laws and Legal Control in Rural Society

The key to legal control is the impact enabled by the law on people's behavior.In the case of rural society,Whether people accept legal control or not lies in two aspects: 1) whether people can accept the ideas of rights offered by the law;2) whether the law can provide the people with guarantee for their rights,namely,whether the law has the power to solve problems.As far as the law-promulgation is concerned,the accomplishing of first aspect is relatively easy,while the accomplishing of second respect not only relies on the basal governments' ruling by the law,but on the rural autonomous organizations' giving full and true play to their functions of autonomy,being able to offer a cushion belt between individual rights and government powers,hence the true realization of the law's effective control over rural society.
