公诉格局一体化的构想

随着全球化的民主与法治的发展,英美法系和大陆法系相互借鉴和愈益趋同,公诉制度也不例外。我国公诉制度改革也愈益迫切。本文结合我国公诉制度的现状,提出了公诉格局一体化的设想,并对公诉格局一体化的含义、理论依据及其具体内容等进行了充分阐述。公诉格局一体化有助于整合公诉资源,促使公诉人正确履行公诉权,提高公诉效率,维护司法公正和进一步保障人权。

Conception on Integrated Structure of Legal Prosecution

With the global development of democracy and legality, legal systems between Britain, the U.S. and Chinese Mainland are inclined to be cross-referenced and assimilated. Legal prosecution is no exception. The legal prosecution in China is calling for an urgent reform. This paper puts forward a conception on integrated structure of legal prosecution in light of the current situation of China's legal prosecution system. At the same time, it illustrates the meaning, theoretical grounds and specific content of integrated structure of legal prosecution. The integrated structure helps better allocate resources of public prosecution, impel public prosecutors to exercise their prosecution right rightfully, increase prosecution efficiency, safeguard justice of jurisdiction and further guarantee human rights.
