| 摘 要： | 从法的价值入手,对商法的价值进行分析.把商法的价值定位为商法的自由价值、秩序价值和效益价值,三者以自由价值和工具价值、效益价值为终极价值形成一个价值体系.联系时代的社会状况认识商法的价值和意义,当前以及今后商法的价值发展应该放在保障效益价值上,这是市场经济发展的必然结果.

| Abstract: | At the base of the value of the law, the social ground in which drove the commercial to be on the historical stage is analyzed. By comparison, the value of the commercial law is divided into three parts: freedom -oriented.order- oriented and efficiency-oriented. We should put the value of the commercial in the whole modern society to get the important meaning of it. |
