| 摘 要： | 我国的刑事诉讼法律没有对辨认作出适当的规定，辨认笔录的证据能力和证明力，也就一直是个争议不休的问题。尽管在实践中，辨认笔录的证明力有其深厚的理论基础，但由于辨认本身所存在的问题，辨认笔录的证明力并未达到充分的境地。从辨认本身所依据的规律出发，完善辨认的程序，是提高辨认笔录证明力的必然途径。 |

| Abstract: | Our country＇s criminal prosecution law has nnt given the suitable stipulation to the identification, record evidence ability and the eertifieate strength, also always is a dispute continuous question. Though the testifying force of the identifying notes has a deep theory foundation in praetiee, beeause of itself prohlem, the testifying force of the identifying notes have not reached a sufficient condition. From the law which the identifieation has its basis on, perfecting the identifying procedure is a necessity approach to improve identifying notes. |
