| 摘 要： | 民法本位是民法的指导思想和标准价值，宣示了民事法律规范的任务和功能。它的确定和厘清对于当今热烈酝酿中的民法典草案的修订和完善具有重要意义，也有利于引导这个过程去找寻永恒的最高价值的向标，促进整部民法典完美融合。结合民法的私法特质，考虑目前中国法治、民主和权利观念的强化，中国民法应当坚持私主体权利本位，促进中国市民社会的发展和权利意识的进步。
