| 摘 要： | 反向混淆是一种新型的商标侵权形式，它不仅会使消费者产生混淆，而且会损害在先商标人的信誉。必须根据反向混淆的不同情况具体分析侵权的救济方式，并适当引入权利衡平和权利通约理论解决争议商标的权利冲突。

| Abstract: | Reversed confusion is a new form of trademark infringement,it would not only confuse consumers,but also will damage the credibility of the former trade holder .Only according to the reverse confusion case-by-case,we can analyse the different infringement of the way to relief,and introduce appropriately theories of right balance and right commensuration to resolve the right conflict of trademark dispute.. |
