| 摘 要： | 道德的法律化是道德与法律关系中一个带有根本性的问题。道德的法律化不仅是一个客观存在的事实，而且有着学理上的根据。同时，道德的法律化又必须受到应有的限制。既不能不区分道德的性质盲目地实施道德的法律化，也不能不顾道德与法律各自的特点．把所有的道德要求都直接移植为法律。

| Abstract: | The legal trend of morality which exists not only in fact but also in theory is a basic question beween law and morality. Meanwhile the legal trend of morality should be limited to some extent. We should not carry out the policy of the legal trend of morality without considering the essence of morality, or transplant all the contents of morality into framework of law without the consideratrion of the separate characteristics between morality and law. |
