人性、人伦与法治--中西比较的视角

法律与人性善恶的逻辑关系取决于社会实践中的人伦关系设定。中国古代专制的形成是以性恶论与家国一体的现实为基础的，法律成为一种压抑人的自律意志的对立物；而西方由自然法推演出民主法治的关键在于承认以人的存在与需要来评价法律的合理性，法治是与人性相一致的自律性规范体现。人性与法律之逻辑关系的正确理解是推进中国特色的法制现代化的方法论前提。

Human Nature, Human Relation and Law Ruling--From the View of China-West Comparison

The logical relation between law and the good and evil depends on human relation in the social practice. The formation of Chinese ancient autarchy was based on the evil nature theory and the unity of family and state,in which law is the opposition suppressing man's free will,while the western democratic law,induced from natural law,is based on man's existence and needs which evaluates the rationality of law,in which law is the embodiment of self-discipline in accord with humanity. The correct understanding of the relation between law and humanity is the premise of the methodology of pushing law modernization with Chinese characteristics.
