| 摘 要： | 作为侵权行为的特殊表现形式，共同侵权行为的构成要件有其自身的特点。但学界及多数国家立法所确认的要件却存在很大的差异。尤其是对共同侵权行为的核心要件“共同性”的本质认识，更是众说纷纭。本文通过历史的和比较的方法对上述学说加以评析后，提出了“修正折衷的原则”。另外，本文还分析了我国共同侵权行为立法现状，并提出了自己的完善构想。

| Abstract: | As one kind of particular tort behavior, joint tort have its own features in it's constitute conditions . But there are many differences in theory and many country's tort law, particularly to joint torts ' commonness which is the core of constitute conditions, no common recognition has been reached. This essay will come up with a new rule after discussing all kinds of theories, with historical and comparative methods. in addition, the author also analysis our country's legislation about joint torts and give some advice. |
