| 摘 要： | 法治是现代国家的必备特征 ,建设法治国家已是全社会的共识。建设法治国家是个庞大的系统工程 ,对法治国家起基础性决定作用的是市场经济 ,在市场经济基础上形成不同的利益集团 ,由此孕育出了民主政治、多元化的价值理念和理性主义的文化 ,这些是法治国家形成的政治、文化条件 ;同时 ,法治还要求在一个相对稳定的、多元的、开放的社会环境中才能发挥作用。比较我国目前的政治、经济和文化条件 ,我国的法治进程将是一个漫长的、不可预期的进程。

| Abstract: | The rule by law is an essential character of a modern country.Constructing legal state is a great systematic project,in which market economy plays a basic and decisive role.Various interest groups based on market economy help to develop democracy,pluralisitic valuation and rationalistic culture that serve as political and cultural conditions in constructing legal state.Meanwhile,the rule by law will be functioned in relatively stable,pluralistic and open social circumstances.Compared with our country's reality in politics,economy and culture,it is inferred that process for our country to construct legal state will be long term and unpredictable. |
