免费师范生的合同研究

免费师范生政策,可以帮助没有足够的资金接受高等教育的学生完成学业,但由于就业政策的约束,使免费师范生丧失完全自主择业和未来若干发展机会的权利。在该政策的引导下,学生与学校和教育行政部门签订了三方合同,但该合同究竟是行政合同还是民事合同,抑或是公法私法化的行政合同,还是私法公法化的特殊民事合同,都有待进一步争论,但无疑,无论何种性质的合同,对免费师范生的教育权利的保障并不十分充分,因为,在合同的背后,折射出教育不公平的精神内涵。

Study on The Contracts of Free Normal Students

The policy of free normal students which can help students who have not enough money to finish their higher education.However,this policy has some items restricted students to choose jobs by themselves and to obtain future development chances.In the direction of this policy,there has a contract which is signed by student/school and the administrative department of education,but what is the nature about this contract which is an administration contract or a civil contract is still a big problem in the future discussion,and this contract reflects inequity of education which hasn't completely protected free normal students' rights to education.
