| 摘 要： | 反倾销规避措施是反倾销措施的延伸和发展,已演化成一种重要的贸易保护手段,建立我国的反规避法律制度对维护我国在国际贸易和国际投资中的利益具有巨大而深远的现实意义。目前,我国的反倾销条例对反规避问题作了相关规定,但内容简单且操作性不强。因此我们应该通过对欧美国家的反倾销立法考察和借鉴,尽快完善反规避的法律制度,使其具有可行性和操作性,在国际贸易中真正起到维护国家及企业合法利益的作用。

| Abstract: | Anti-circumvention measure has involved to an important safeguard in international trade,as it is the outcome of extending of antidumping measures.Setting up an anti-circumvention legal system in our country has great and farreaching meaning to protect Chinese proper benefit in international trade and international investment.There are several provisions on anti-circumvention problem in new Chinese antidumping regulation,but these provisions are too simple and vague to operate.So we should improve legislation of anti-circumvention as soon as possible after using the merits of EC and US related legislations for reference. |
