| 摘 要： | 随着高新技术的不断发展，技术标准及其与知识产权的结合日益成为学界关注的焦点。本文首先从技术标准的概念、种类等基本理论问题入手，厘清了其与相关范畴的界限。随后，论证了技术标准与知识产权的关系，并从知识产权的角度分析了技术标准与知识产权相结合带来的问题及其法律规制。

| Abstract: | Along with the high new technical in development increasingly, the problem of technical standard has become the focal point in the educational world. This article discusses the elementary theory of technical standard firstly, such as the concept, types. Afterwards, it debates the relationship between technical standard and intellectual property , then analyzes the legal question brought out by the combination of them from the intellectual property angle, and proposes some measures in the end. |
