兼职大学生权益的法律保障研究——以“法律适用分析”为中心

兼职大学生与用人方之间所成立的关系的法律属性不能一概而论，应当具体问题具体分析。从法理上讲，其有部分属于一般意义上的劳动关系：另有部分属于民事雇佣关系。鉴于我国目前保护兼职大学生权益的困境——我国在司法实践上将兼职关系排除在《劳动法》的调整范围之外：在民法上缺乏对雇佣关系的专门规定。因此要解决上述困境，就必须对《劳动法》重新做出相应的司法或立法解释，以代替原劳动部1995年出台的《关于执行〈中华人民共和国劳动法〉若干问题的意见》．将属于劳动关系的那部分兼职劳动关系纳入劳动法的调整范围以及在民法（特别是合同法）中增加调整民事雇佣关系的专门规定。
