论非婚同居中弱者权益的法律保护

广义的非婚同居更加有利于保护非婚同居中的弱者合法权益，自20世纪中叶以来，肯定非婚同居，对非婚同居进行规制，保护非婚同居中弱者的合法权益已经成为世界主要国家的立法趋势。在我国，非婚同居现象大量存在，但法律对于非婚同居一直采取规避态度，理论界对于非婚同居也趋于保守。因此，有必要扩大非婚同居内涵，界定非婚同居中的弱者，同时，更重要的是通过法律对非婚同居中弱者的合法权益进行保护。

The legal protection for the rights of the disadvantageous in unmarried cohabitation

Generalized unmarried cohabitation is more conducive to protecting the legal rights and interests of the disadvantageous in unmarried cohabitation. Since the middle of the twentieth cen-tury, regulating unmarried cohabitation and protecting the legitimate rights and interests of the disadvantageous in the unmarried cohabitation has become a trend of legislation in the main countries of the world. In China, despite that there is a large number of unmarried cohabitations, the marital law has been neglecting (taking evasive attitude to) the unmarried cohabitation, while the academic circle tends to be conservative. So it is necessary to expand the connotation of unmarried cohabitation, to define the disadvantageous in unmarried cohabitation, and to protect the legitimate rights and interests of the disadvantageous in unmarried cohabitation.
