| 摘 要： | 元朝烧埋银不仅是对犯罪分子的附加刑罚，更是对犯罪被害人及其家属的损害赔偿。学界普遍认为元朝烧埋银源于烧饭，这种看法实有妥当。蒙古早期命价银习惯法才是其矗的源头。作为中国历史上第一个损害赔偿法律制度，烧埋银有着适用范围广、立法水平高等特点。并对以后的中国法律和民众意识产生了很大的影响。

| Abstract: | The origin of Shaomai-Yin system was thought as Shao-fan .In my opnion,it's more likely originated from the Wergild in early Mongolian society.Shaomai-Yin system is used not only to punish the prisoner,but also compensate for the victims.As the first compensation system in Chinese history ,it has been having an effect on Chinese laws from then on. |
