行政监督失范现象分析

我国当前的行政监督存在意识模糊、形式失调、程序不畅、方式单一、对象失衡等失范现象。对这些现象进行深层次的分析，不难看出我国行政监督失范现象主要是由于监督主体的利益追求与价值离散、监督对象的权力制约与权权交换、监督量规的法制“真空”与体制“黑洞”及监督外围的意识谈化与胆怯心理等产生的。针对这些问题应采取健全监督独立机制、构建廉政法律机制、落实廉政教育机制、完善外围监督机制、建立权力资本分离机制等对策。

An Analysis of Norm- hosing Phenomena about Administrative Supervision

The current norm-hosing phenomena about administrative supervision i n China mainly include the unclear consciousness, maladjustment of form, detaine d procedure, simplex method, and unbalanced objects. Through these phenomena, we can attribute their causes to the supervision subjects, supervision objects, su pervision regulations and supervision environment. In the light of the existent problems, the writer of this paper proposes the following countermeasures: 1. St rengthen the mechanism of supervision independence. 2. Construct incorrupt mecha nism of law. 3. Carry out incorrupt mechanism of education. 4. Perfect mechanism of external supervision. 5. Establish the mechanism of separating authority and capital.
