| 摘 要： | 认识1999年新《合同法》的促进交易原则对正确理解，运用合同法意义重大。该原则在合同法中的体现是合同法理论成熟和社会经济基础条件成熟使然。它从质和量两个方面确保和促进交易的发生。它在合同法中不仅体现在其订立制度，履行及解释制度与前三部合同法律有较大的不同，而且其在《中华人民共和国合同法》中具有原则条件的限定，克服了它的副效应。

| Abstract: | It is significant to study the Law of Contract made in 1999, especially the part that favours trading. When this principle appears in the law, that is to say we have a good understanding of the law, and have solid economic foundation in China. The Law of Contract made in 1999, guarantees and promotes trading both in quality and quantity, which are new features in legislation, appliance and interpretation. These features help to eliminate the side effects in trading. |
