论我国《农产品质量安全法》追溯制度的完善

当前我国农产品质量问题产生的根本原因在于信息不对称，责任不可追溯。我国《农产品质量安全法》中有关追溯制度的规定存在总体上不够重视、追溯链不完整、追溯记录内容不全面、企业追溯系统缺失、政府部门对追溯的引导、服务和监管不明确等不足，应通过修法，严格农产品追溯制度，完善追溯记录内容以及追溯各环节、各主体的追溯义务，强制建立生产者的追溯系统，明确规定政府对追溯的引导、服务和监管职责等，为农产品安全管理提供制度支撑。

On the Perfection of Traceability System in Quality and Safety of Agricultural Product

Currently, the quality problems of agricultural products are mainly caused by the information asymme- try and lack of responsibility tracing system. This paper points out the shortages of the relevant provisions about the traceability system in the present Quality and Safety of Agricultural Product （QSAP） ： insufficient emphasis on the whole, incomplete traceability chain, content missing of traceability records, lack of enterprise traceability system and government departments＇ uncertain guide, services and supervision on the traceability, etc.. Based on the study, this paper suggests that the government should promote the amendment of legislations to improve traceability system, clarify the responsibility of each entity and specify the supervision duty of the government de- partments. The aim is to provide legal basis for QSAP control.
