| 摘 要： | 在中国古代,作为家庭规范、社会规范、治国方略的“孝”对司法具有重要的影响,主要体现在:一是对子孙复仇的原宥;二是子孙侵犯父祖的刑罚加重主义;三是父母为了子孙气忿自尽,子孙也得承担逼死父母的责任。

| Abstract: | In ancient china,as one of the family regulations,social rules and a way of governing the whole country,xiao played an important role in the ancient judicatory,which was embodied in three points.First of all,xiaomade the whole society accept the revenge thought and condone revenge actions.What's more,if the junior aggrieved the senior,judges would punish the junior more severely than ordinary criminals.In addition,if the senior died due to actions of the junior,the junior should take the rap. |
