简论继承权中的道德权

道德权系指公民在各项权利实现过程中,由个人做出的道德选择权利。进而,道德继承权是指这种道德选择行为,又决定着行为人能否真正应该和能够实现其继承权。这一概念的提出,其目的在于将公民的身份权利与公民的义务指引统一起来,进一步贯彻“任何人都不得从其错误行为中而得益”的重要主张①,真正保障婚姻家庭的幸福、稳定,体现今日之文明社会中关于婚姻家庭及继承的立法精神②。

A Talk on the Right of Morality in the Right of Inheritance

The right of morality refers to the right of morality choice on the part of the individual in the process of realizing all sorts of rights.The right of inheritance,the behavior of morality choice,determines whether or not the agent should or could attain his/her inheritance.The purpose of bringing forth this concept is to unite the identity right and obligations of citizens and to further implement the crucial proposal that "no benefits could be gained from one's improper behavior" so as to fully warrant the happiness and stability of marriage and family and to embody the legislative spirit of marriage,family and inheritance in modern civilized society.
