浅析法官的自由裁量权

在某种意义上,司法过程是对民主和正义的一种考量,立法体现民主,而司法则更多地代表正义。司法活动本应严格依法进行,但法官毕竟不是机器,而且为了裁判的合法又合理,需要赋予法官考虑案件特殊性的权力,也就是自由裁量权。但是,自由裁量权如果规制不当,又会被滥用。正确的态度是一方面赋予和保障法官的自由裁量权,另一方面对其加以适当的规制,以充分发挥其正面价值。
