中英民事案件管辖制度之比较

英国司法制度多为世界各国借鉴之榜样。从对中英两国民事案件管辖制度内容简要介绍入手,归纳建立四级法院体系、为便利当事人而设置初审法院的管辖权、地域管辖的连接点为被告住所地和诉因发生地、允许当事人选择法院和上级法院移送案件到下级法院的共同点,可知最高法院的民事初审管辖权、初审法院管辖范围的依据、地域管辖规定的结构、管辖权转移的情形和条件、法官的专业化程度、案件上诉的条件的不同点,提出合理设置法院、取消最高法院的初审管辖权、推动法官专业化的实现的建议,以期为我国民事案件管辖制度的发展提供经验。

Comparison of Civil Cases Jurisdiction between England and China

The British judicial system is the example for countries all over the world. This article, by briefly introducing both our and British jurisdiction systems ,intends to generalize and set up four court systems, and establish the jurisdiction of the first instance court. The connecting point can be the defendant residence or the place where the cause of action happens. The parties are allowed to choose the court and the common connecting point where the superior court transfers the case to the lower court. They cab be aware of the Su- preme Court＇ s civil trial jurisdiction,the basis of a trial court jurisdiction,the structure of territorial jurisdiction rules ,the situation and condition of jurisdiction over the transfer ,the judges＇ degree of specialization and the conditions of appealing, and can make suggestions on setting up court reasonably,canceling the Supreme Court＇ s first trial jurisdiction and promoting the implementation of the judges＇ specialization,for the purpose of providing valuable experience for the development of civil jurisdiction system in our country.
