摘    要:随着十八届三中全会的召开,国家对当前社会经济体制各方面进行了全面深入的改革,并明确提出建立城乡统一的建设用地市场,赋予农民更多财产权利,明确对土地使用制度的顶层设计进行了改革,更加引发社会各界关注。这一制度虽然赋予农民集体对土地的支配权利,但是,加快集体建设用地使用权流转在有效扩展农民财产权、维护农民权益的同时,也带来诸多新问题,本文通过分析集体建设用地使用权流转内涵和积极作用,同时深入剖析这一制度带来的不利影响,进而提出一些意见和建议。

Advantages and Disadvantages Analysis on Circulation of Rural Collective Construction Land

Abstract:China on the current social and economic system reform in all aspects of a comprehen-sive and in-depth ,identified the establishment of the integrated urban and rural construction land mar-ket ,giving people more property rights ,expressly to reform land use system of top design and raised the concerns of the community .This system gives mercy of peasant collective land rights ,but speeds up cir-culation of collective construction land use right valid extension property rights of farmers ,safeguard farmers’ interests at the same time ,it also brings a host of new problems ,based on the analysis of con-notation and positive role of collective construction land use right transfer ,while an in-depth analysis of the negative impact of such a system ,and made a number of observations and recommendations .
