| 摘 要： | 邓玉娇案引出了我国当前评价司法公正的焦点问题——是社会标准还是法律标准？相当于评价司法公正的社会标准，法律标准具有确定性、技术性和客观性。区别于生活中的一般观念——“客观真实”、“实体正义”与“保护弱者”，坚持评价司法公正的法律标准，我们需要正确地理解“法律真实”、“程序正义”与“法律面前人人平等”的含义。

| Abstract: | The case of Deng Yu -jiao reflects the focal issue of evaluating judicial fairness in China choosing social standers or legal standers. Compared with social standers, legal standers have the characters of certainty, objectivity and technicality. In order to distinguish the notions ＂objective truth＂, ＂noumenalism＂ and ＂protecting the weaker＂ we use in daily life form those in law, we need correctly understand ＂legal truth＂, ＂procedural justice＂ and ＂all men are equal before the law＂. |
