| 摘 要： | 我国在司法实践中，由于长期没有对表现代理作出规定，导致在民事审判中对表现代理的理解不同，往往把表见代理与狭义无权代理相混淆，在审判实践中，代理人与本人之间具有某种特殊关系，是否构成表现代理应视具体情况对待。

| Abstract: | Abstract: During the judicial practice,it has not defined the rules of mandate apparent for such a long time that people make the different ideas about the mandate apparent; people always mix the mandate apparent with the narrow senses of unauthorized agency. In the judgement practice there is a special relationship between the a-gent and the principal, whether it is regarded as the mandate apparent depends on the concrete conditions. |
