| 摘 要： | 目前理论界对于环境侵权自力救济的认定,主要适用传统刑法与民法正当防卫、紧急避险的构成理论。但是,自力救济不等于正当防卫与紧急避险,环境侵权也不同于一般民事侵权,因其具有诸多特殊性,故有必要从分析自力救济构成要件与环境侵权特征出发,对环境侵权自力救济的构成要件进行再认识。

| Abstract: | In theory,people presently judge self-help of environmental infringement mainly according to the theories of traditional criminal law,legitimate defense in civil law and necessity.However,self-help is not equal to legitimate defense or necessity,while environmental infringement is not common civil case infringement.Because of many of its specific characteristics,it is necessary to review the constitutive requirements of selbstshilfe of environmental infringement by analyzing the constitutive requirements of selbstshilfe and features of environmental infringement. |
