| 摘 要： | 2005年中国、美国相继发生了两起轰动性案件，从对案件发生、社会反应到司法处理等各个环节的比较，可以发现中美宪法文化思维方式存在着显著不同，而当事人的命运与宪法文化思维方式的不同有着重要的关系，这为我国宪政制度、宪法文化建设提供了有益的启示。

| Abstract: | In 2005, two sensational cases occurred one after the other in China and the United States respectively. A comparison of the two cases in terms of social response and judicial treatment reveals that there exist remarkable differences between the constitutional cultural thinking of the two nations and the fate of the clients is related to such thinking in different ways. Such revelation is of great significance to Chinas building of a constitutional system and constitutional culture. |
