论住房公积金制度的法律完善

押住房公积金是单位和职工必须缴纳的长期住房储备金,具有保障性、强制性、专属性、互助性的特点。但现实中单位未缴、欠缴住房公积金的现象相当普遍,直接损害了职工的利益。在目前法律缺失的情况下,探讨如何解决住房公积金的缴存问题,引导职工如何维权。同时,对住房公积金的风险管理提出了相应对策。

On Legal Consummation of the Housing Accumulation System

The housing accumulation fund,as a long-term reserved fund,should be compulsorily paid by both employees and employing units.It appears the characteristics of safeguard,compulsion,exclusiveness and mutual-aid.Whereas it has been prevailing practice for the employing units to be inactive and inadequate in paying housing accumulation fund,infringing upon the interest of the employees.In view of the default of relevant laws at present,this article not only tries to explore solutions to the problems concerning the payment and deposit of housing accumulation fund but also puts forward some counter-measures with regard to its risk management,in an attempt to enable the employees to protect their own rights.
