建设工程监理法律地位的实证分析

目前我国法律对建设工程监理法律地位的界定尚不够明确，学术界也一直存有争论，影响着建设工程监理职能的正常履行。主流观点有“中立第三方的观点”“代理人的观点”以及“折中的观点”。从实证法的角度出发，结合三种主流观点，通过对国际惯例、其他国家（地区）以及我国对建设工程监理法律地位的规定进行比较分析，“代理人的观点”比较合理，并最终将建设工程监理的法律地位界定为业主的代理人。

Empirical Analysis on Legal Status of the Supervision for Project Construction

The orientation of the legal status of the supervision for project construction is not very clear in our country, and there are many different ideas in the academic circle. The three main ideas are ＂the viewpoint about neutral third party＂, ＂the viewpoint about agent＂ and ＂the viewpoint about compromise＂. From the perspective of empirical study, combined with the three main ideas, this paper compares and analyzes the legal provisions of the international convention, the convention in other countries （regions.） and in our country, at last, the legal status of the supervision for project construction is identified as the agent of the developer, because the ＂the viewpoint about agent＂ is more reasonable.
