| 摘 要： | 从方法论上看,法律发现可被认为是法律方法的一种,即法官应用法律的一种活动。法律发现和法律渊源有内在的联系,法律渊源的研究对法律发现具有重要意义。法律渊源的研究有助于在司法过程中克服法律的局限性,约束法官的自由裁量权力,增强司法结论的确定性。

| Abstract: | Legal finding is one of the legal methods from the aspect of methodology.It is an activity of judges' applying law.Finding law has internal relation with source of law.The study to source of law has significance to legal finding.The study of source of law is helpful to overcome the defects of a law,restrict the jurisdiction of judge,and improve the certainty of verdict. |
