论信托受益权的性质

受益权在信托关系中有着极其重要的地位，确定受益权的性质是一个十分重要的问题。关于受益权的性质有着众多的观点，笔者认为确定受益权的性质应分别从狭义受益权和广义受益权两个方面去考察。在性质上，狭义受益权属于物权，广义受益权属于特殊的新型权利。
