| 摘 要： | 公共性是义务教育的一种基本特性。义务教育的公共性主要由免费性、世俗性、平等性、责任性与强制性五个部分组成。教育法律的一项很重要的使命就是要对教育本身所具有的公共性进行强制性地捍卫与保障。新修订的《中华人民共和国义务教育法》对于义务教育的公共性作出了积极有效的回应,这不仅有利于促进义务教育公共性的实现,而且也将会有利于推动义务教育事业的进一步发展。
